  • Served (and serving) as court appointed receiver of 11 companies (not including insurance companies) including hotels, ski area, water park facility, golf course, construction company, apartment and condominium complexes. Activities include but not limited to asset value-adding, stabilization, personnel matters, utility issues, irrigation, advertising, insurance, issues relating to prior management, appraisal and sale.
  • Serving as Court-Appointed Special Deputy Rehabilitator of Old Standard Life Insurance Company (Idaho); Special Deputy Liquidator of Wasatch Crest Mutual Insurance Company (formerly Electric Mutual/Energy Mutual)(Utah) and Wasatch Crest Insurance Company (formerly Utah Home Fire Insurance Company)(Utah).
  • Served as Special Deputy Liquidator of United Republic Life Insurance Company; Commercial Surety and Insurance Company; Bonneville Life Insurance Company; Maxicare of Utah; Universal Indemnity Insurance Company and Southern American Insurance Company. Also serving as Reinsurance Coordinator of Southern American Insurance Company in Liquidation; Activities include managing company, managing and value-adding assets, adjudicating claims against the insolvent estate; claims and administrative activities including interfacing with guaranty associations, collecting reinsurance receivables and recoverables owed by reinsurers through commutation or other collection mechanisms, manage all aspects of litigation involving the estate and its assets including foreclosures, lending practices, insurance claims, personnel matters, matters involving asset recovery including litigation against prior management, attorney and accountant malpractice, preference and voidable transfer cases.
  • Past consultant to the Nevada Insurance Commissioner on applications for formation of captive insurers pursuant to the Nevada captive insurance laws.
  • Consultant to the Utah insurance Commissioner on troubled company issues.
  • Assist in drafting and implementing portions of the Utah Insurance Code.
  • Past consultant to the New Jersey Commissioner of Banking and Insurance on insurer insolvency issues especially relating to insurance insolvency proceedings.
  • Arbitrate and mediate complex insurance and commercial disputes.
  • Assist insurance companies with regulatory compliance, Form "A" and other regulatory compliance matters including certificate of authority applications, rate and form filings, surplus lines listing and others.
  • Creation and management of domestic property and casualty and Life and Health insurance companies.
  • Serving as member of the National Association of Insurance Commissioners (NAIC) committee assigned to prepare a training program for state court judges on matters relating to insurer insolvencies.
  • Member of the Receivers Handbook subcommittee of the NAIC. Frequent lecturer at educational seminars sponsored by the International Association of Insurance Receivers, NAIC, Mealey's Seminars, Cambridge Reinsurance Symposiums and other sponsoring organizations regarding regulatory and insolvency matters.
  • Drafted and had enacted a new property and liability guaranty association statute (31A-28-100, et seq., Utah Code).
  • Served as CEO, COO of various corporations owned by insurance companies in receivership ; managed all of the real estate and other holdings of all insurance companies in delinquency proceedings in Utah since 1989, including apartment buildings, shopping centers and manufacturing facilities; manage or recently have managed receiverships with total assets in excess of $500 million (including recoverable reinsurance) and annual operating budgets in excess of $85 million.
  • Served as adjunct professor of Administrative Law, University of Utah (Quinney) Law School.


1991-1996: Utah Insurance Department Served as Director of Liquidations, Utah Insurance Department (UID) Administrative Law Judge, UID which included presiding over hearings relating to mergers and acquisitions, disciplinary matters, rules hearings and disciplinary and investigative hearings; Served as staff counsel to the Utah Insurance Department. Lectured at various insurance industry functions on solvency matters and market conduct matters, served as liaison to the Utah Property and Casualty Insurance Guaranty Association and the Utah Life and Disability Insurance Guaranty Association, lectured to national meetings of both the National Organization of Life and Health Insurance Guaranty Associations (NOLHGA) and the National Congress of Property and Casualty Insurance Guaranty Associations (NCIGF) as well as the Utah Chapters of both organizations (ULDIGA and UPCIGA). Served as Insurance Department representative to the Insolvency Committee (now the Insolvency Task Force)of the NAIC; Responsibilities at the NAIC included Chair of the Guaranty Fund Issues Working Group; Regulatory Coordinator of several chapters of the Receivers Handbook; member Rehabilitators and Liquidators Model Act Working Group; member Federal Issues Working Group.

1990-1991: Utah Insurance Department (UID) Created and served as Director of Solvency Surveillance Division, UID. Duties involved the creation and management of a financial analysis unit within the UID. Supervised several divisions within the UID.

1987-1991
: Utah Insurance Department Market Conduct Counsel (Staff Counsel). Duties involved investigating and prosecuting violations of the Insurance Code by agents and companies, evaluating rates and forms filed by companies, presiding at rules hearings and performing various other functions within the UID. During service at UID, wrote numerous Rules including Unfair Claims Settlement Rule, Unfair Discrimination Rules, developed and implemented Utah Continuing Agent Education statues and Rules. Contributed to or wrote various statues including Claims Estimation Statutes. Served on Utah Attorney General's Special Committee on the Utah Administrative Procedures Act.

Prior: Partner, Johnson and Stillman Attorneys at Law (1979-1986). Emphasis on Personal Injury, Workers' Compensation and Criminal Defense litigation. Served as Chair, Utah Medical Malpractice Prelitigation Panels during 1986. Trained Mediator.
